GC-020 Notice of Hearing Guardianship or Conservatorship



This form is used to notify people that the court will hold public hearings to establish a conservatorship, establish rights to be retained by the proposed conservatee or given to the proposed conservator(s), approve a conservator’s accountings, and hear objections. This form cannot be sent out until the date of the hearing for conservatorship is set by the Clerk of Court. You bring it in with the initial GC-310 Petition for Appointment of Probate Conservator and they will stamp it with date and department line 4a, page 1, GC-020. You will file this form GC-020 after the people have been served.

While proposed conservators can complete this form, make copies, address envelopes, you must find someone over the age of 18 that can serve GC-020 Notice of Hearing Guardianship or Conservatorship by placing a copy of GC-020 in an envelope addressed to the people listed in the notice and mailing it with the United States Postal Service. The person doing this action must not have an interest in the conservatorship of the proposed conservatee. Neighbors and friends are fine. Relatives, doctors and nurses of the proposed conservatee are not. You want a neutral person.

The serving of this notice can be done in person but the server must use GC-020(P). It must be signed by each person who performs the in person service and attached to the GC-020 Notice of Hearing Guardianship or Conservatorship that is submitted to the Clerk of Court.

This notice must be filed with the Clerk of Court 15 days before the scheduled hearing date.

SECTION 1460-1469

1460. 1460.1. Not with standing any other provision of this division, no notice is required to be given to any child under the age of 12 years if the court determines either of the following: The part of this section of the Probate Code deals with children that are part of an Indian Tribe (1460.2) or if the conservatee is in a State Hospital (1461) and can be found here:

I do not include it because only a small portion of cases are affected by this part of the Probate Code and it is long.

1461.4. 1461.5. Deals with notice of the time and place of hearing on a petition if money is received from the Veterans Administration. Use the above link to read.

1467. If service is made by mail pursuant to this division in the manner authorized in Section 415.30 of the Code of Civil Procedure, the service is complete on the date a written acknowledgment of receipt is executed.

1469. Where a provision of this division applies the provisions of this code applicable to personal representatives to proceedings under this division, a reference to Section 1220 in the provisions applicable to personal representatives shall be deemed to be a reference to this chapter.

Under Probate Code §2700, interested parties may request special notice of petitions filed in the guardianship or conservatorship proceeding, inventories and appraisals of property in the estate, accounts of the guardian or conservator, and proceedings for the final termination of the guardianship or conservatorship proceeding.
